TERMS OF SERVICE AND DISCLAIMER AGREEMENT
Nature and limits of the service
KindCall Community is a routing, notification and automated family reassurance platform. It is non-clinical. We do not monitor real-time health data or provide physical home visits, and the service is not a substitute for clinical care or emergency services. On basic automated tiers, we route alerts to the user’s designated contacts but do not call or dispatch emergency services (999). Designated contacts remain responsible for responding and deciding what action to take.
Call and alert reliability
The service depends on third-party calling and telecommunications providers, the recipient’s phone and settings, battery power, and network conditions. Calls or alerts may be delayed, missed, interrupted or fail, including because of signal loss, outages or a depleted battery. We do not guarantee end-to-end uptime or successful delivery of any call or alert. Do not rely on the service as the sole safety measure. In an active emergency, call 999 directly.
Optional operator monitoring
If a human-operator service is separately selected, active and available under the user’s plan, alerts may be routed to an operator under the stated service coverage. An operator may contact emergency services where appropriate, but no operator intervention or emergency-service response is guaranteed. This feature does not replace calling 999 directly in an active emergency.
Calls and voice recordings
By proceeding, you confirm that the person receiving calls has agreed to receive them and, where the selected service includes recording, to safety-check voice notes being recorded and made available to the designated contacts or dashboard users described for that service. The person receiving calls should be told which events trigger recording and who can access the recordings.
